Cyclists' Defence Fund urges police to review case of boy, 12, killed while cycling

Inquest into death of Jake Mitchell heard that driver who killed him had attempted to overtake three cars and a tractor

The Cyclists’ Defence Fund is to ask Leicestershire Police to review a case in which a 12-year-old boy was killed as he rode a bike to a water park with friends during the school holidays in 2014 after a coroner criticised a motorist for deciding to overtake a tractor moments before striking and killing the youngster.

Jake Mitchell died when he was struck by a Nissan Qashqai driven by Maurice King from Market Bosworth at around noon on 29 July 2014, with the coroner’s inquest hearing that the motorist had been attempting to overtake three vehicles and the tractor when the youngster veered into his path.

The driver said in a police interview that he had not seen Jake and his two friends before the collision, but other drivers giving evidence at the inquest confirmed that they had, reports the Leicester Mercury.

While Robert Chapman, Assistant Coroner for Rutland and North Leicestershire, attributed the cause of Jake’s death to a road traffic collision, he was highly critical of the motorist.

"It seems to me that the decision he made to overtake was the wrong decision,” he said. “I cannot accept for a minute it was appropriate to pull out of this line of traffic and overtake them.

“What I cannot accept, irrespective of the cyclists, and he says he didn't see them, is that it would be the action of a prudent motorist to pull out and attempt to overtake the line of traffic and tractor when only 400m ahead there is a bend that he cannot see round.”

Following legal advice, the motorist did not answer questions at the hearing because of the prospect of potential future proceedings.

The assistant coroner added: "Whatever conclusion I come to and whatever my findings are from the last two days, it doesn't prevent the police or CPS taking a further view on Mr King's responsibility. It also doesn't prevent the family taking forward civil proceedings."

The inquest was told that Jake had been riding with two friends aged 14, and was using one of their bikes which was too big for him, and had to stand on the pedals to try and keep up with them. He is thought to have veered across the road since he was scared at being so close to the tractor.

The charity Cycling UK has been supporting Jake’s family, and its Senior Road Safety and Legal Campaigner, Duncan Dollimore, commented: "It shouldn't have taken 28 months before anyone listened to the evidence of the three other drivers queuing behind the tractor, who Mr King overtook.

"They had all decided it was too dangerous to overtake, and were aware of the young cyclists ahead of the tractor.

He added: "Cycling UK's CDF will be writing to Leicestershire Police asking them to review the case in light of the evidence given to the coroner and his observations concerning Mr King's actions."

Even if the children hadn't been cycling in front of the queue of traffic, it sounds from the limited information we have, that he shouldn't have been overtaking there anyway.

Another case of driver impatience getting people killed.

It seems as though the element of blame from coroner is the fact he shouldn't have overtaken because there was a bend 1/4 mile up the road, not the fact there was children on bikes (which the bloke obviously couldn't see).

In my opinion the bloke isn't entirely (but mostly)to blame for what's happened. He hasn't hit oncoming traffic as a result of the overtake and it does sound like the boy did cross into his path as he correctly used the opposite side of the road to overtake.

Take away the element of the other cars and just say he was the first car behind the tractor, should he sit there all day behind vehicles doing 15mph at most? If I was behind a tractor that wasn't going to overtake cyclists and I had 400m of clear road, I'd do it. You've got to overtake at some point and you probably don't expect the cyclist to change direction as you pass.

I'll admit that I've sometimes overtaken multiple cars because people (usually pensioners in japanese cars)just won't overtake tractors sometimes and you get the point where it's if you won't, I will.

 

The whole thing is an unfortunate shitstorm and if it was my child then I'd probably want the driver strung up and rhyme and reason would go out of the window.

You are right of course, it does seem that regardless as to the situation that he overtook, the same result would happen. However the situation in this case was extreemly dangerous and should be punished accordingly.
The take away for me from this on the other side is the dangers of children riding bikes that are too big for them. Previously I had held issues about children riding bikes too big but only from the myriad of stories online as to it putting them off cycling. I now have a new and far more alarming perspective on this to share.

The thing was, he was 4th car back in a line of traffic, without going into the full maths it seems a risky manouver to complete in the 400m not forgetting allowances for traffic coming round the bend towards you

Unfortunately not unusual behaviour. I see these sort of risky manoeuvres every day (most of us do). I can't see it changing unless thesee people start to be removed from the roads. That might make the others pause & think before acting.

Obviously executing the mfcker to death might attract some attention too!

killed a 14 year old boy ffs....all because he couldnt be arsed to wait in his friggin car.

I hope something bad happens to him as we can be sure the CPS will be giving no shits

If DCF are asking for the case to be reviewed by the police, that implies that they have already taken the decision not to prosecute the driver, otherwise there would be nothing to review.

Apparently not, the police haven't got around to it yet, presumably waiting for the inquest result http://www.nuneaton-news.co.uk/heartbroken-nuneaton-parents-seek-justice...
