Near Miss of the Day 764: Fixed penalty notice for driver overtaking cyclist despite oncoming traffic
A positive ending for our latest Near Miss of the Day clip, with this video being reported to the police and resulting in a fixed penalty notice and the driver being sent on an improvement course.
road.cc reader Stuart was riding out of Stourport-on-Severn along the A4025 Worcester Road when a driver of a red Audi sped past, despite oncoming traffic preventing them executing a safe pass.
Stuart reported the driver to the police, and was told they had received a fixed penalty notice and would be sent on an improvement course. A different story to yesterday's near miss...

Two fairly textbook safe passes follow in the footage, before another rushed overtake with another vehicle coming the other way. Only the Audi driver was reported.

Please also let us know whether you contacted the police and if so what their reaction was, as well as the reaction of the vehicle operator if it was a bus, lorry or van with company markings etc.

This happens every single ride, without fail, in Surrey. Usually multiple times. I stopped sending footage to the police because they did nothing (yes, that's the force that Road CC fawns over because they put a few tweets out there).
What we need to know is what the 'fixed penalty' was- if it didn't include points on the licence, it was worthless. If the 'improvement course' was a joke online version, it was also worthless

the Northumbria police force is very good at issuing FPN, they are very proactice against close passes
Well done to this force for issuing a FPN, but this raises the eternal question of why some police forces will issue such a fine when other forces won't even send a warning letter. We've seen many worse such passes on NMoTD where the local force take no action whatsoever.
We need a national standard for such driving, and I'd suggest starting with whether another road user was put in fear of their life, if so, then that's dangerous.
Agree. It beggars belief that there isn't a national standard.......
And its weird that even when the National Chief Rozzer (NPCC) organisation agrees a set of standards (which I believe they have done) that half of them cant be arsed to follow it.
What can cyclists do to create consistency across the forces???
I read something about funding issues in some constabularies. Isn't it also true that the income stream here should lead to sustainable law enforcement.
So. Where's the issue? What can cyclists do to help improve enforcement throughout the UK????
and the half that don't follow it are the ones giving out FPN's. The national standard blocks FPN's being issued for public submitted video footage.
Have a stiff drink ready and read the comments on any of the NMotD posts on that Bookface thing. No matter how terrible the driving, a proportion of people will say it was fine.
The police will display the same range of opinions as exist in the general population, albeit probably not in the same proportions. If your submission ends up with an officer towards the "it's fine" spectrum, you get NFA. And even situations where the offending vehicle is a police vehicle - as in one of the posts on this thread IIRC.
The police need educating on what is and isn't acceptable; anyone who can't be shifted from the Cyclist Bingo crap is unsuitable for traffic duties.
We were slowly cranking up a local, short, step hill last weekend. I could hear a van behind us, and sensed the driver was an impatient so and so... and of course, they overtook over the blind brow of the hill, causing the driver coming the other way to stop.
The offending vehicle was a police van 😐
It's not unique to this country. White van man did that on a blind bend in Mallorca last week forcing the oncoming vehicle to brake hard while veering into a field.
